Oakland Park Seawall Raise Deadline: 60 Days, 365 Days and 2035

Oakland Park does not require every seawall to be raised by a set date. After a citation, Section 14-1 gives 60 days from notification to show progress and 365 days from the citation to finish. New and substantially rehabilitated walls applied for before January 1, 2035 may be built at 4 feet if designed to reach 5 feet by 2050 (Ordinance O-2022-015).

Two clocks with two starting points

Oakland Park's wording is slightly different from some neighbors. The 60 days to show progress run from receiving notification, and the 365 days to complete run from receipt of the citation (Ordinance O-2022-015). If those two dates differ on your paperwork, plan around the earlier one.

What triggers enforcement

  • Disrepair, Sec. 14-1(C). A barrier that lets tidal water flow unimpeded through or over it onto adjacent property or the right-of-way is presumed to be in disrepair, and failing to maintain it is citable.
  • Nuisance, Sec. 14-1(D). Barriers below 5 feet NAVD88 must be improved to keep tidal water off adjacent property. Letting tidal water trespass is a public nuisance, with the same 60 day and 365 day clock to complete an approved remedy.

If the needed repair is substantial, the owner must design, permit and build improvements that meet the elevation and design rules within the 365 days.

What eats into the year

The city's seawall permit packet asks for a notarized Broward County Uniform Building Permit Application, documented proof of cost, sealed seawall and pile plans meeting Chapter 14, sealed surveys with existing and proposed elevations, a special inspector form, the Broward County Property Appraiser's assessed valuation, and contractor registration if your contractor is new to the city (city checklist). Engineering, structural and zoning each review the plans.

Hurricane season on an open job

The city's packet reminds contractors that during a hurricane watch, before hurricane force winds arrive, construction sites must be secured under Section 110.13 of the Broward County administrative provisions of the Florida Building Code, with loose materials lashed down or stored inside (city permit packet). A wall rebuilt between June and November should have that in its schedule.

The 2035 and 2050 dates

These apply only when you build a new wall or substantially rehabilitate one: apply before January 1, 2035 to use the 4 foot allowance, and design that wall to reach 5 feet by January 1, 2050.
